Days passed! I was going to office as usual. Every month there were court dates, but she never came to court. As judge also never asked Public prosecutor to produce her, nor did my lawyer ask.

Every Date I was present and waiting for my name to call; Whole day I have to wait on door of court room, and when my name called just show my face to judge and he will give another date; this is how Indian Court Harass, most of the cases never reach any solution or judgments; As everyone knows LAW is Blind but
Indian law is not only BLIND but DEAF and DUMB too.

On 27th October 2000 Friday; I was watching some English Movie on Star Movies.
At 10.30 my door bell rung; I thought, they came again for something as they used to come at night only to harass me, insult me.

I Opened the door chain on, so they cannot come in; when I saw, they were not there, instead 3 men were standing; I could not see their face clearly as there was no direct light other than faint zero volt bulb. They were look like street guys and unknown.

I said “YES??? as I have not seen them before.

One of them, asked in Hindi, idhar D’souza kidhar rehetha hai?
As there were 2 more D’souza family on my same floor, so I asked them again;
Kaunsa D’souza?
They were confused, as they did`t remembered first name.
Then third fellow who was standing behind two guys in front asked;
Sunita ka husband..

Now I knew, they came for me.

So I asked
Main hoon, kya hua..

They tried to push the door to open, even one guy kept his foot between doors, so I could not close it.

Bahut charbi hai thereko,
thereko sikayega, bahar aa, thera moo pe acid pekega..
Railway track pe dhakka marega

They just keep on saying anything,

I pushed the door to close, as I knew now, they were sent by my wife’s sister who killed her own Brother to get marry a man, because her brother was against her union.

All of a sudden they stopped pushing door and just fade away;

I was surprised why they left, they I came to know that some was coming up stair talking, so they left all of a sudden.

I went gallery, from there I can see, who is coming to our building;

When I saw down; those three men were walking away from our building and there was Red maruthi Omni was waiting for them.

I could not sleep that night;

Next day morning I wakeup early, and went to meet Vasai priest and told him everything; he advised me to leave Vasai and go somewhere.

There was no time to shift my things from home, so I kept everything as it is. Just closed all windows and door, and locked house and went in hiding, even telling neighbors my parents or my office colleagues.

No one knew where I went.

I was contacting my office colleague Sameer Nair and asking him to contact my lawyer to find out next court dates. As I was getting dates after dates in her absence.

I still believed she woukd come back some day. Even the Vasai Parish Priest assured me, "She will know what she has done and come back to you".

Once she met me on the way and I asked about my son Glenn and how he was. She said, "he is not your son" I didn't know whether this was a riddle or she was telling the TRUTH.

The Vasai Priest was calling her every now and then. Once, she came with her cousin-sisters and warned the Priest not to call her. Their actual words were “Do not harass us!!!".

After Few days; when I called her Office, her colleague said she wanted to talk. Our argument reached nowhere. Then I asked the Priest to make her understand and Priest asked her to come to his Ashram to talk. She came on Saturday after office hours and Priest cancelled all his other work and sat with us and explained what marriage is all about. She listened carefully, but she was stubborn. She said if I write my Father's apartment in her name she will come back. But that day I have come with her to her other sister's home in Borivili and took her back. But when she came she brought only one dress! That was sign that she would not stay long. Next day she got up and went to work but did not return to my home. I knew it that she would do like this. That was third time I tried to bring her back.


On other side, 498A court dates were going on but she didn't come for single date and I was visiting Thahasildhar every month as Police Inspector directed me. On 2nd October court date, she came after judge ordered her to be present, but she demanded, she will compromise if I come to her native place home and take her back. So, the Judge told me to go there and bring her back and settle this case.

On 10th October along with My Dad and our Other Church Priest we went to meet her parents. Here also as soon as they saw me, her Father was angry and wanted to beat me with the help of his son–in-law, her sister's husband. We returned back without any word. The Church Priest gave us a letter, what had happened and said the meeting was a failure because of her Father and I showed that letter to the Judge.

On 12th she called me to my Office phone from her Native place, “Why did you desert us????"
I said in a calm voice, "Listen, I came to your house so many time and your Father wanted to hit me, beat me. Next time if you want to come, come yourself. I’ll not bring you or ask you again."

I think after few days there was no contact from her, then once she called the Vasai Priest and talked to him. So the Priest called her, as I told him I’m leaving my job and going abroad. That night she asked only one thing, "Are you going abroad or not?" I said no. Then she said Priest lied to her that I’m going aboard. Now I knew why she came back.


Next morning, I got up early. I went down and brought milk and bread and prepared Sandwich, which My son Benn likes very much, as both were sleeping. When they got up, she dressed up and got ready to go. I knew it, she would leave, because she was thinking I’m going abroad and she can stay here. But I denied saying I’ll not go abroad. Benn wanted to have Sandwich and said mumma, mum mum, he was calling eatables as mum mum, but she pulled him and left. I was sitting on the sofa, shocked, even when Glenn was asking for sandwich and she didn't allow him to eat. She stood on door step and said, "I’m Going!"
I said.. "If you Cross this door-step today, this door will never open for you again!"

Again she said, "I’m going". She pulled Glenn and left on her own Free choice and Free will.

After 2 months of all this nonesensical drama, I called her so many times. She was working somewhere in Andher.
I was calling her on her office number. I begged her to come back; at least for child sake!

She said come to my sister's place and take me back, I said I'll not come anywhere as you left on your own.

After some days she came on her own, telling that she still have some things to take. On the door step itself she said she didn't come to stay.

I allowed her in;Benn my son was also came with her; he was very much fond of me before, now he act like a stranger and Afraid to come to me

I gave him his favorite GEMS chocolates;

she said say thank you…..

He thanked me… saying
THANK YOU UNCLE

Hearing this, she laughed, sarcastic laugh and seems so happy

36. Police Complaints

After that night, their visits became just routine.

She started to come every night with her cousin sisters after 10 PM and started to abuse me, insult me and checking how I kept the house and what I cook. If I did not open the door they started to bang, as I was totally alone and didn't have any close relatives either in Vasai.

Next Sunday, my Dad Came from my native place, and introduced Vasai priest Fr.Peter Bombacha as he was very good friend of my dad. He assured my dad here after I’m like his son. If anything happens he will look after me as he was having very good hold over Vasai people.
Father advised me to meet a well known person in Vasai who can tell police to stop this threat and abuse and that gentlemen came with to police station and told Sub Inspector and Inspector told me if they come again to Abuse me, to lodge a Complaint at police station.

After few days my Dad left to native place then, Again they started to come for the reason that she has some of her clothes to take. They were not taking those clothes, but in the name of clothes they were coming in and abusing me.

I filed complaint LC-1012 dated 17/07/2000, that day Inspector called her cousin sisters and told before dawn take Everything whatever she left in my house. That day they came and took whatever they left even her Torn clothes.

After that we lost contact as she was staying at her sister house and working somewhere in Andheri. Once I met her at Vasai Railway station. I asked her how are you, she just smiled a faint smile. I saw she was not wearing mangalsutra; it was symbol of her marriage. So she was ready to break this marriage.
Then I asked Vasai Priest to call her, and make her understand. In the next one month the Priest called her office number so many times; not less than 50 Times as none of the Priest can do that much.

I also called her and she said next week her Father is coming to Bombay; come home and ask him if he says; she is ready to come back. On 29/9/2000 me and my dad who came to Bombay Again went to her Cousin home to take her back or talk. Her Father was also there, when we reached their home other than her Father, her sister husband and one more person were drinking alcohol; as soon as they saw my face her father came towards me to hit me as he was high in alcohol. Her cousin sister stopped him and said not in my house. Then he started to threatened me to break my limbs and back, we came back from there without talking anything and lodged complaint about it at Manikpur Vasai Police station LC No:1527/2000 dated 29/9/2000. For that also police didn't take any action.

Next day on 6th July, I went to office as usual.

No one knew what had happened in last 2 days. I didn't tell anyone about it.I just missed my son Ben, as he was wishing Good-bye when I was leaving to office.
I liked his sleeping on my chest when I got up in the morning.
He used to eat breakfast from my hands!

I wept for hours thinking about him.

He was not with me, still I was hearing his voice and foot steps.

I felt no hunger or thirst.

I came back from office, and prepared only rice and had it with plain pickle.

At around 10 PM, someone rung my door bell, and I opened it.

I saw that she was standing there with her two cousin sisters. One of the cousin-sister's husband was in jail for 7 years for murder.

I asked, "What do you want now?"
She said I have my cloths here, I want to take them.

I allowed them in.

They did not came to take cloths, but insult me, humiliate me, they checked kitchen what I have prepared there was nothing, they laughed at me saying see now he is sleeping empty stomach.

I told them, get all your things and get lost!

She took Everything, her cloths, utensils and everything she think that belongs to her. Even she took
5 gold Chains which I and my parents gave to Ben!
One of Ben's Bracelet which was given by my Brother!
One my chain worth almost 25,000 Rs. Given by my Brother.
My 2 rings!
2 rings I gave her!
2 Chains worth 40,000 Rs, which I gave it to her.
One Bracelet!

Other than gold she also took one lakh worth Insurance which I made for her and paid all premium.
Another Insurance worth 50000 in Glenn name!

That day I didn't know, what they are taking, I was made to sit in hall when she was packing in the Bedroom.

They took Everything and left after one hour laughing at me.

Next Day was the 5th of July. Early morning, they gave me samosa and Tea.

At 8 AM some of my relatives came to see me; as my Parents informed them.

I told them what had happened.

At 10AM The Police Station Sub Inspector came and they took me to him.

At that time one my relative asked one of the local Ex-Corporator to come.

Inspector asked me, "Did you beat your wife?"

I said, "She left 20 days back, then how can I beat her 3 days back?"

Immediately he said to one of the constable, who was writing Charge sheet, “Panch sau chaar tak re??? [Apply IPC 504 too]

It was Additional charge, just because I said, "She left 20 days back".
Police can charge you falsely in India if you tell the truth.

Altogether they charged me with the following:

IPC 498A: “Cruelty by husband or relatives of husband”
IPC 323 : “Voluntarily causing hurt with full knowledge and intention”.
IPC 504 : “Intentional insult and provocation for breaking public peace”
IPC 506 : “Criminal intimidation with a threat to cause death”.

And the wise inspector asked me to go to the Thahsildhar for 6 months, every month and get his sign on some paper too!

I do not know why he charged me with all this. ????

My charge sheet was filled on the same day.

There was neither Enquiry nor Investigation!

I also told him she took all my Gold! Still he said, "If I utter one more word he will put me on lockup and will not produce to court for a week".

Then everyone told me not to talk anything.

After that they gave me lunch

At 3 PM they took me to court handcuffed,

They took me to court like a thief, like one who convicted for murder! They produced me to court.
I was standing with other Criminals.

When my turn came; the judge asked me, "Do you want to Plead Guilty or not?"

I said, “NO” Boldly!

My Relatives arranged one lawyer, he told something to judge and the judge allowed me to go to home.

After I called up home and informed my parents, the police has arrested me!

The Police made me to sit on a Cold bench till 11 P.M.! Then they told me to go back to the cell, so that they can lock me up.

I said, "I will sit outside, I will not run away".

They knew that I would not run away, still they said that they wanted to sleep (They sleep on duty)! So they asked me to go to cell.

They took my wallet and searched for any metal objects and strings which I did not have. Not even that, they took my Scapular too.

There was one more guy already in the cell. It was dark and stinking with urine smell! There was no proper clean place to sit either!

So I was standing holding Jail Cell bars.

At 11 PM their duty changes and new shift police came and they didn't know why I am arrested. As I was looking ordinary with my old clothes, they thought I am arrested for some theft or so, one police came to me and started to poke me with his Police stick and asked me to sit back as I was standing for long holding iron cell bars; he was new shift duty police and did`t know why I am in, then other police told him why I am arrested.

I think his name is Kadam; he asked me what had happened;

I told him in brief!

He said, if he was in my place he would have cut her in to 2 pieces after she filed false case.

That whole night I spent Standing Holding those cell iron bars.
